No. Illinois law does not generally require you to hire a lawyer simply because you are selling your home without a real estate agent. But selling FSBO does not eliminate the legal work involved in selling a home.
In fact, when there is no listing agent involved, it can become even more important for a seller to understand who is handling the contract, disclosures, title work, closing documents, deadlines and problems that arise between contract and closing.
That is where a real estate attorney comes in.
FSBO Means “For Sale By Owner,” Not “Do Everything Yourself”
Selling FSBO usually means that the homeowner has decided not to use a traditional listing agent.
The seller may handle things such as:
- Pricing the property
- Advertising it
- Scheduling showings
- Communicating with prospective buyers
- Negotiating the basic business terms of the sale
But once a buyer is found, the transaction moves from marketing a property to creating and completing a legally binding sale.
That is a very different job.

What Does an Illinois Real Estate Attorney Do in an FSBO Sale?
Depending on the transaction, a seller’s attorney may help with several important parts of the sale.
The purchase contract
The contract establishes much more than the sale price.
It may address earnest money, financing, inspection rights, closing dates, possession, personal property, tax prorations, contingencies and what happens if one side fails to perform.
An FSBO seller should be particularly careful about signing a contract provided by the buyer or the buyer’s real estate broker without first understanding exactly what it says.
Required seller disclosures
Selling without an agent does not automatically eliminate disclosure requirements.
Depending on the property, an Illinois seller may have obligations involving the Residential Real Property Disclosure Report, radon disclosures, lead-based paint disclosures and other documents.
Attorney review and inspection issues
Many Chicagoland residential contracts contain provisions allowing attorneys to review and propose modifications to the agreement after it has been signed.
Inspection issues may also arise shortly after the contract is executed.
A seller’s attorney can help address those issues and negotiate with the buyer’s attorney.
Title and closing preparation
A seller also has to deliver what the contract requires at closing.
That can involve title work, mortgage payoff information, transfer documents, tax prorations, municipal requirements, condominium or homeowners association documents and final closing figures.
A cash sale does not make these issues disappear.
What If the Buyer Already Has an Attorney?
The buyer’s attorney represents the buyer.
That attorney’s responsibility is to protect the buyer’s interests, not the seller’s.
The Illinois State Bar Association has cautioned that, in most circumstances, one lawyer cannot simply represent both the buyer and seller in the same real estate transaction.
An FSBO seller should therefore not assume that the buyer’s attorney can handle everything for both sides.

When Should an FSBO Seller Contact an Attorney?
Ideally, before signing the purchase contract.
Once you sign a contract, you may already have made legally binding commitments concerning the price, closing date, contingencies, possession, credits and other important terms.
Getting legal advice beforehand gives you an opportunity to understand the agreement before those commitments are made.
So, Do You Need a Lawyer?
Illinois does not generally require an FSBO seller to hire an attorney simply because the property is being sold without an agent.
The more useful question is:
Do you want to handle the legal side of the transaction yourself?
Selling without a Realtor can eliminate one professional from the transaction. It does not eliminate the contract, disclosures, title work, deadlines, closing documents or possibility of disputes.
For many FSBO sellers, hiring an experienced real estate attorney allows them to handle the sale without a listing agent while still having someone responsible for protecting their legal interests and helping move the transaction toward closing.
